These Terms of Service ("Terms") govern access to and use of the Voxlytics outbound calling and post-call intelligence platform, including our website (voxlytics.ai) and application (app.voxlytics.ai) (together, the "Service"), operated by Voxlytics ("Voxlytics", "we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. Use of the Service

Voxlytics provides tools for outbound dialing, campaign pacing, browser-based calling, and AI-generated post-call analysis. You agree to use the Service only for lawful purposes and in accordance with these Terms.

3. Customer Responsibility for Calling & Recording Compliance

You are solely responsible for ensuring that your use of the Service — including outbound calling, autodialing, call recording, and any telemarketing or collections activity — complies with all applicable laws and regulations in the jurisdictions where your contacts are located, including consent, do-not-call, recording-disclosure, and data-protection requirements. Voxlytics is a platform provider and does not verify the legality of any specific campaign, contact list, or call.

4. AI-Generated Content

Call transcripts, summaries, sentiment, and other outputs generated by AI features are provided for informational and operational assistance only. They may contain inaccuracies and should not be treated as a verbatim or authoritative record without independent verification where accuracy is material.

5. Customer Data

You retain ownership of the lead data, contact lists, call recordings, and other content you upload or generate through the Service ("Customer Data"). You grant Voxlytics a license to host, process, and analyze Customer Data solely to provide and improve the Service. See ourPrivacy Policy for how we handle data.

6. Fees & Payment

Fees for the Service, if applicable, will be described at the time of purchase or in a separate order form/agreement. Fees are non-refundable except as required by law or as expressly stated at the time of sale.

7. Acceptable Use

You agree not to use the Service to:

  • Place calls without a lawful basis or required consent;
  • Violate telemarketing, robocall, do-not-call, or recording-consent laws;
  • Transmit unlawful, fraudulent, harassing, or abusive content;
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or
  • Resell or sublicense the Service without our prior written consent.

8. Suspension & Termination

We may suspend or terminate access to the Service, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or pose a risk to the Service or other users. You may stop using the Service at any time.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED OUTPUTS WILL BE ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXLYTICS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold Voxlytics harmless from any claims, damages, or expenses arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law, including laws governing outbound calling and consent.

12. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The specific courts/venue for dispute resolution will be specified once Voxlytics completes incorporation.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
